Arizona has freed its courts of litigation over compensation claims through its state compensation law. This statute is all-inclusive and is designed to be fair to both employer and employee.
Claims of both workers and employers are administered by the Industrial Commission of Arizona (ICA), which consists of 3 members who have divergent political affiliations. No outside influences shape their decisions and these are made without prejudice.
Because of the set-up under which ICA functions, all money paid into it in the form of premiums is used solely to settle claims and administer its operation. So far, it has been able to pay claims to the amount of more than $8,000,000. It has been proved adequately able to meet the continuing awards to widows, orphans and those permanently injured.
Through the all-inclusive features of the Arizona Industrial Act, which assures justice to all, there are no short-cuts by which it may be avoided. Employers are invited to seek information in relation to their own particular employment problem and to use the facilities offered by the Arizona Industrial Commission for mutual benefit to all.
Following an accident, employees must report the accident and all details to both their employer and the Industrial Commission. This record then permits the proper handling of the case and avoids delays and misunderstandings.
ICA was established in 1925 because of impending constitutional legislation that established a system for workers’ compensation. From its inception until 1969, this workers’ compensation system was made up of the State Compensation Fund and self-insured employers. In 1969, the workers’ compensation system opened up to also include private insurance companies.
There are 2 branches of the ICA, one in Phoenix and one in Tucson. The policy-setting portion is comprised of a 5-member commission who has a 5-year term and is appointed by the Governor and confirmed by the Senate.
